Identification of the Vendor
These General Terms and Conditions of Sale are applied by Ultramasx Technologies Pte. Ltd. a company under Singaporean law, registered at 160 Robinson Road #14-04, Singapore 068914, with registered N° 201920903R at the Accounting and Corporate Regulatory Authority (ACRA) of Singapore.
Scope of application and acceptance of the General Terms and Conditions of Sale
Any purchase of a product(s) proposed on the Internet site www.ultramasx.com (hereinafter referred to as the “Website”) is regulated by these General Terms and Conditions of Sale.
Ultramasx Technologies Pte. Ltd. products are proposed for sale solely to end consumers, whether these be natural or legal persons, excluding all retailers and all intermediaries who might act on behalf of retailers. As a consequence, the customer declares that he/she acts as the end consumer and that he/she does not intend to resell any Website product for commercial purposes.
Ultramasx Technologies Pte. Ltd. may update these General Terms and Conditions of Sale at any time; the version in force may be directly consulted on the Website, which also indicates when the updated terms and conditions were added.
The General Terms and Conditions of Sale in force at the time a purchase is concluded apply to its sales contract.
For every product purchase on the Website, you will also be asked to confirm acceptance of the General Terms and Conditions of Sale in force at the time the order is placed. To confirm acceptance, you should check the box “I have read and accept the General Terms and Conditions of Sale and I agree to the use and privacy policy of the www.ultramasx.com website”.
In the case of natural persons, purchases and/or supply requests are accepted only when made by adults. Should a minor wish to make a product purchase and/or a supply request through the Website, the minor must be authorized and supervised by a parent or legal guardian.
Any product proposed through the Website stands as an invitation to trade, and the order sent by the customer stands as a purchase contract proposal and/or supply request, which is subject to confirmation and/or acceptance by Ultramasx Technologies Pte. Ltd., as under the terms set out hereinafter. Therefore, Ultramasx Technologies Pte. Ltd. will have, at its unquestionable discretion, the right to choose whether to accept an order from a customer, without the latter objecting to or challenging this decision on any grounds and/or for whatever reason.
The sales or supply contract regarding a product(s) is intended as concluded once Ultramasx Technologies Pte. Ltd. (“the Owner”) has accepted the contract proposal by the customer (“the User”). The Owner shall accept the User’s contract proposal by sending order confirmation to the email address provided by the User, or by viewing an order confirmation webpage, featuring: the order information, the User’s personal information, the product characteristics and availability, the price and the method for price calculation, any further charges and/or additional taxes, the delivery address, the delivery times and costs, if applicable, the procedure for exercising one’s right of withdrawal from the contract and any exclusion of this, and warranty details.
The product supply or sales contract is not to be considered as effective between the parties if the conditions set out at the previous point have not been observed.
Should the product(s) be unavailable, Ultramasx Technologies Pte. Ltd. shall inform the User of the new delivery or supply times, asking whether he/she wishes to confirm the order. It is understood that the contract is considered as applicable only in relation to the product orders accepted by the Owner.
The User undertakes to check that all the information set out in the order confirmation is correct and to notify the Owner at once of any mistakes therein. The User also agrees to conserve copies of his/her order, its confirmation and the General Terms and Conditions of Sale.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Creating an Account
In order to benefit from all the Website functions, to make purchases more quickly and easily, to track orders and to stay constantly up to date on new arrivals in the Ultramasx realm, customers can register, providing completely and truthfully all the information required by the relative registration form, and accepting in full the privacy policy and the Terms and Conditions.
The customer is responsible for the safe-keeping of his/her log-in credentials, which must be used solely by the customer and may not be disclosed to third parties. The customer undertakes to keep this secret, to ensure that no third party has access to them, and to immediately inform Ultramasx Technolgies Pte. Ltd. should he/she suspect or know of misuse or improper disclosure of these. The customer confirms that the personal details provided during the registration process are complete and truthful, and he/she undertakes to indemnify Ultramasx Technologies Pte. Ltd. and avoid it harm from any damage, liability obligation and/or penalty deriving from and/or in any way connected to violation by the customer of the Website registration rules or its rules for the safe-keeping of the registration credentials.
A registered User may break off use of the Website at any time, and may deactivate his/her account or request its deletion by sending written notification to the email address support@ultramasx.com. In the event of the customer violating the General Terms and Conditions of Sale or the applicable provisions of the law, Ultramasx Technologies Pte. Ltd. reserves the right to suspend or close the customer’s account at any time and without prior warning.
Selecting Products
You may add a product(s) to your selection at any time by clicking on “add to basket”; you can then choose to complete your purchase or continue exploring the Website. You can see what you have selected by clicking or placing the mouse cursor on “basket” in the upper right menu. This will show product photos featuring: the relative colour(s) and references, the quantity chosen and the relative unit price, with the partial total for the selection. Ultramasx Technologies Pte. Ltd. reserves the right to modify its product prices and any pertinent additional costs at any time. It is understood that price changes shall not in any way affect contracts already concluded before this modification.
Currency
Payments will be billed in US dollars.
Payment by Credit Card, Debit Card and PayPalAll the credit card and debit card payments on our Website are managed through third party independent payment gateways PayPal and Stripe in order to guarantee the highest security and efficiency to our customers.
The customer undertakes to pay the product price within the due time and respecting the procedures set out on the Website, and to provide all the necessary information requested. The Website uses third-party payment gateways to process payments and does not in any way come into contact with the payment details provided (credit card number, cardholder’s name, password, etc.). Should these third-party gateways deny payment authorisation, Ultramasx Technologies Pte. Ltd. will be unable to supply the product(s) and cannot in any way be held responsible for this.
Ultramasx Technologies Pte. Ltd. shall in no way be held liable in the event of any fraudulent or illegal use that third parties may make of credit cards or other means of payment, in that the company does not come into contact in any way with the payment details used (credit card number, cardholder’s name, password, etc.).
Ultramasx Technologies Pte. Ltd. and its payment gateways utilise the latest technologies in terms of security like SSL encryption to prevent card data from being intercepted or manipulated.
Should any transactional fees be applied by the customer’s banks or card issuers, these will not be refunded by Ultramasx Technologies Pte. Ltd.
The order will be immediately dispatched once the payment has been credited to our company. In case of pre-orders, the Company might sell products not yet available in its warehouse for immediate shipping.
Billing
Any customer wishing to receive an invoice will be asked for billing details. The information used to issue the invoice will be that provided by the customer, who declares that it is truthful, fully indemnifying Ultramasx Technologies Pte. Ltd. regarding this information.
Taxes and Duties
Additional customs or import duties, if any and if applied by customer's country, are not applied. The customer is responsible for their payment if applied. The item prices and delivery costs exclude VAT at current rates and are shown as gross prices.
Shipping Policy
Ultramasx Technologies Pte. Ltd. uses best in class third party logistics to manage its warehouses and to ship its products, all seamlessly connected via the Internet with our online e-commerce platform. We ship all of our products from our two warehouses in California, USA and Hong Kong, SAR, worldwide. Our daily cut-off time is at 10AM EDT for USA shippings and 10AM HKT for shippings to the rest of the world. Once the order is completed on our online store it is transmitted automatically within one hour to the logistics management platform for fulfillment and shipping. We ship exclusively with trackable and best in class couriers in order to provide the quickest and safest delivery service available on the market.
Tracking
As soon as your order is dispatched, you will receive automatically an email and/or SMS containing your tracking number. So you can check delivery status online immediately after receiving the tracking number.
Withdrawal
Withdrawal from purchase is not permitted once an order has been placed on our website. We allow 1 hour delay between the order is placed and the fulfilment of it. In that time you might request to amend the details of the order but not to cancel it, before it is shipped.
Returns
Our products are non-returnable due to hygiene and personal protection nature of the them. However, in the unlikely event of damaged, defective or different item delivered to you, we will provide a free replacement. We may contact you to ascertain the damage or defect in the product prior to issuing a replacement.
Assurance
Ultramasx Technologies Pte. Ltd. is obligated to supply to customers products that comply with the sales contract. It is assumed that products comply with the contract if they comply with the description given by the Owner and if they possess the product characteristics that Ultramasx Technologies Pte. Ltd. presented on the Website.
Therefore, the provided assurance of compliance excludes, in its field of application, any fault or malfunction caused by accidental occurrence or under the customer’s responsibility, this being product use not complying with the purposes and/or information set out in the technical documentation supplied with the product.
Force Majeure
The Owner cannot be held liable for the late performance of its obligations, or the entire lack thereof, if this occurrence is caused by circumstances beyond the Owner’s reasonable control and due to a force majeure event or, in any case, to an unexpected and/or unforeseeable event.
Warranty, Refunds and Replacements
We offer a one year warranty on the core body of the mask, which includes its electric components, motor and battery. The consumables like the filters and the silicone parts are not included in the warranty.
If a product you have received is 1) defective and/or faulty, due to manufacturing flaws, or 2) incorrect and/or different from what you ordered, or 3) damaged due to carelessness during shipping, then you can request a free replacement or refund of the faulty and/or incorrect and/or damaged product.
A request for replacement or refund must be made within one year of the product delivery date, by sending an email to support@ultramasx.com. Clear and detailed photos and/or videos should be attached to the email specifying the type of claim, order number and the products for which you wish to claim the free replacement.
Our customer care assistants will check that the request is well-founded and complies with the terms. Following this, a replacement order will be issued at our expense and shipped with the fastest courier available to your country.
Remember: once goods have been delivered to you, you are responsible for their condition, so treat them with care!
The Following Conditions Exclude the Validity of the Warranty
* All human-caused effects, damage and/or performance failure caused by use under abnormal operating conditions or failure to use according to the instructions;
* Damage caused by dismantling;
* The validity of the eligible period has expired;
* Altered invoice or lack of purchase receipt and/or warranty card;
* Damage caused by other force majeure events (such as flood, lightning strike, earthquake, abnormal voltage).
Industrial and Intellectual Property Rights
Ultramasx Technologies Pte. Ltd. declares that it is the owner and/or licensee of all the intellectual rights regarding and/or inherent to the Website and/or the Website contents. As such, all the trademarks, visual or otherwise, and all other identifying graphics, trade names, service brands, brand names, company names, illustrations, images, logos and contents present on the Website are and remain the property of Ultramasx Technolgies Pte. Ltd. and are protected by the laws in force regarding trademarks and the relative international agreements.
Any unauthorized attempt to reproduce the explanatory texts and/or contents present in the Website’s application will be considered a violation of the Owner’s industrial and intellectual property rights.
